Distance Sales Agreement

1. Parties

This Distance Sales Agreement (the "Agreement") is concluded electronically between Pixbuff Bilişim Teknolojileri Ltd. Şti. (the "Seller"), whose details are given below, and the buyer who makes a purchase on classbuff.com (the "Buyer").

Buyer

The Buyer's name, email address and billing details are those entered by the Buyer on the checkout page and shown in the order summary.

2. Subject of the Agreement

This Agreement sets out the rights and obligations of the parties, under Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation, regarding the sale of the digital learning content pack (the "Pack") ordered electronically by the Buyer on classbuff.com and its assignment to the child profile selected by the Buyer.

3. Pack, price and payment

The name of the Pack, the content it includes, the child profile it will be assigned to, any discount applied and the total sale price including all taxes are shown on the checkout page at the time of the order and form an integral part of this Agreement.

Payment is taken by debit or credit card through iyzico Ödeme Hizmetleri A.Ş., a licensed payment institution. Card details are never seen or stored by the Seller. The price shown at the time of the order is not affected by later price changes.

4. Delivery (performance)

The Pack is assigned electronically to the child profile selected by the Buyer when payment is approved. Nothing is shipped. In case of a technical problem, assignment is completed within 24 hours at the latest; if the Pack cannot be assigned within the statutory performance period of 30 days, the Seller refunds the full amount paid.

5. Obligations of the parties

  • The Seller shall provide the Pack in line with the characteristics described in the pre-contract information and give access to it with no time limit for as long as the Classbuff service is offered.
  • The Seller informs the Buyer that the service may be briefly interrupted for planned maintenance or technical reasons; such interruptions do not end the Buyer's right of access.
  • The Buyer confirms that the information given during the order is correct and that they are the parent or legal guardian of the child to whom the Pack is assigned.
  • The Buyer uses the Pack only for the child it is assigned to and may not transfer, sell or share their account or the Pack with third parties.
  • Other rules of use are set out in the Terms of Use.

6. Right of withdrawal

The Pack is a service performed instantly by electronic means and an intangible good delivered instantly to the consumer. Under Article 15(1)(ğ) of the Distance Contracts Regulation, the right of withdrawal cannot be exercised under this Agreement once performance has started with the Buyer's consent. The Buyer has separately confirmed this on the checkout page.

This exception does not remove the Buyer's right to a refund where the content cannot be accessed for technical reasons or in the other cases listed in the Delivery and Refund Terms.

7. Refunds

Refund cases, how to apply and time limits are described on the Delivery and Refund Terms page. Refunds are made to the card used for payment within 14 days at the latest; how long the amount takes to appear depends on the Buyer's bank. A refunded Pack is removed from the child profile.

8. Dispute resolution

This Agreement is governed by the laws of the Republic of Türkiye. The Buyer may apply to the Consumer Arbitration Committee at their place of residence or where the transaction took place, within the monetary limits announced each year by the Ministry of Trade, and to Consumer Courts for disputes above those limits.

9. Entry into force

Before confirming the order, the Buyer confirms electronically that they have read and accept the Pre-Contract Information Form and this Agreement. The Agreement enters into force when payment is approved. A copy filled in with the order details is sent to the Buyer's email address and kept by the Seller for the statutory period.
