1. Parties

These Terms of Use (the "Agreement") are concluded electronically between Pixbuff Bilişim Teknolojileri Ltd. Şti. (the "Company"), located at İhsan Doğramacı Bulvarı, Üniversiteler Mahallesi, ODTÜ Teknokent ETKİM Binası, No:31, 06800 Çankaya/Ankara, Türkiye, and the User who creates an account on the classbuff.com website and Classbuff applications. The Company and the User are together referred to as the "Parties".

2. Definitions

  • Classbuff: The educational game platform offered by the Company through the classbuff.com domain, mobile and tablet applications and WebGL versions.
  • Game: Curious Steps, published on Classbuff, and other educational games to be added in the future.
  • User: A Parent, Teacher or Institution Admin aged 18 or over who creates an account on Classbuff.
  • Parent: A parent or legal guardian who creates a student profile on behalf of their child.
  • Teacher: An educator who creates a class and adds their students to Classbuff.
  • Institution Admin: A person who manages the institutional licence on behalf of a school or educational institution and is authorised to add teachers and students.
  • Student: A child whose profile is created by a Parent, Teacher or Institution and who plays the Games. The Student is not a party to this Agreement and cannot sign up on their own.
  • Free Content: The demo and content that can be used without an account or with a free account.
  • Paid Content: Content accessed through a one-time purchase (Pack), a subscription or an institutional licence.
  • Report: A learning summary generated from the Student's in-game progress and shown to the Parent, Teacher or Institution.

3. Formation of the agreement

By accepting the Agreement during registration, or by continuing with a Google, Microsoft or Apple account, the User declares that they have read and accepted the Agreement. Users must be at least 18 years old to open an account.

The current text of the Agreement is always available on classbuff.com; the User may save or print it at any time.

4. Membership and account types

4.1 Account types

Classbuff has three account types: Parent, Teacher and Institution Admin. Opening an account is free. Institution accounts are opened under a separate institutional agreement between the Company and the institution; in case of conflict between that agreement and this Agreement, the institutional agreement applies.

4.2 Student profiles

Students cannot open accounts in their own name. Student profiles are created by a Parent, Teacher or Institution. For a student profile created by a Parent, a first name or nickname and a grade level are sufficient. For students added by a Teacher or Institution, first name, surname and school number are requested in order to tell apart students with the same name. No student is ever asked for an email address, phone number, photo or location. Students log in with a class code, a picture password or a login card.

4.3 Parent's declaration

The Parent accepts that they are the parent or legal guardian of the child for whom they create a profile, that they will supervise the child's use of Classbuff, and that they have read the Privacy and KVKK Notice on the processing of the child's information.

4.4 Teacher's declaration

The Teacher accepts that they have informed the parents of the students added to their class about the use of Classbuff and the data processed, and that they have obtained parental consent where required by law. A Teacher acting on behalf of an institution fulfils these obligations within the framework of their institution's instructions.

4.5 Institutions

Under an institutional licence, the Institution is the data controller for its students' personal data, and the Company is the data processor acting on behalf of the Institution. The Institution Admin declares that they are authorised to accept this Agreement on behalf of their institution and to add teachers and students.

4.6 Account security

The User must provide accurate and up-to-date information during registration and must not share their password, login codes or student login cards with third parties. A User who suspects unauthorised use of their account must notify the Company without delay.

4.7 Report access via QR code

The QR code shown in the game's parent section allows the student's report to be viewed for 24 hours without an account. The person who shares the QR code or link with third parties is responsible for any consequences of doing so.

5. Content, purchases and fees

5.1 Access levels

Content on Classbuff is offered at three levels: open to everyone, available with a free account, and paid. The level of each piece of content is shown on the relevant game page.

5.2 One-time packs

Packs bought with a one-time payment, such as the Fractions pack, are assigned to the purchasing account once payment is complete and can be used without a time limit for as long as the Classbuff service is provided. A pack covers the content described at the time of purchase; new topics and games added later are not included in the pack and may require a separate purchase or subscription.

5.3 Subscriptions

If subscriptions are offered, the subscription period, fee, renewal terms and cancellation method are clearly shown before purchase. For automatically renewing subscriptions, the User is notified before the renewal date.

5.4 Purchase channels

  • classbuff.com: Payments are collected through the licensed payment institution [PAYMENT PROVIDER]. Card details are neither seen nor stored by the Company. A preliminary information form and a distance sales agreement are presented separately before purchase.
  • App Store and Google Play: For in-app purchases, payment, invoicing and refunds are subject to the rules of the relevant store. Store purchases are assigned to the student profile used in the app; the Parent can add this profile to their Classbuff account via the QR code.

5.5 Right of withdrawal

Packs and subscriptions are services and digital content delivered instantly in electronic form. Under Article 15 of the Turkish Distance Contracts Regulation, the right of withdrawal cannot be exercised for such content once delivery has begun with the User's consent. The User separately confirms this during purchase. Cases where the content cannot be accessed at all for technical reasons are handled under the [REFUND POLICY].

5.6 Price changes

The Company may change prices. Price changes do not affect purchases already completed.

5.7 Homework and paid content

Teachers may also assign paid content as homework. A Student without access to the paid content can play the free part of the homework. The decision to purchase belongs solely to the Parent or the Institution. Classbuff does not show prices, calls to purchase or advertisements on Student screens; such information is given only to the Parent.

6. Rules of use

The User uses Classbuff only for lawful and educational purposes. In particular, the User agrees not to:

  • Create an account with someone else's details or false information, or use another person's account without permission,
  • Use insulting, discriminatory or defamatory names or nicknames in student profiles,
  • Copy, modify or reverse engineer the Games or software, or attempt to circumvent protection measures,
  • Collect content or data with robots, spiders or scraping tools without the Company's written permission,
  • Carry out actions that disrupt the system or place an excessive load on it,
  • Transfer or sell account or licence rights without the Company's approval.

7. Intellectual property

All rights to the Games, characters, images, sounds, texts, software, design, and the Classbuff brand and logo belong to the Company or its licensors. For the term of this Agreement, the Company grants the User the right to use Classbuff for educational purposes: within the family for Parents, in their own class for Teachers, and within the scope of the institutional licence for Institutions. This right is non-exclusive and non-transferable. Commercial use of the content in private tutoring, courses or similar paid educational activities without the Company's written permission is prohibited.

8. Personal data

Personal data of Users and Students is processed in accordance with Turkish Personal Data Protection Law No. 6698 (KVKK) and the Privacy and KVKK Notice. The Company does not sell Student data, does not use it for advertising, and processes it only to provide and report on the learning experience.

9. Service continuity and changes

The Company makes reasonable efforts to provide Classbuff without interruption; however, temporary interruptions may occur due to maintenance, updates or reasons beyond the Company's control. Planned maintenance is announced in advance whenever possible.

The Company may update the games and content in order to improve them. If paid content must be removed permanently, the User is notified at least [30] days in advance, and the options of [providing equivalent content or a refund proportional to the unused period] apply.

10. Liability

Classbuff is an educational tool that supports learning; it does not replace a teacher's professional judgement or school education. Reports are summaries based on in-game behaviour and should not be used on their own as grades or official assessments.

Subject to cases of intent and gross negligence and to liabilities that cannot be limited by law, the Company is not responsible for problems arising from the User's device, internet connection or third-party services (stores, sign-in providers).

11. Changes to the agreement

The Company may change the Agreement due to legal changes or service updates. Material changes to the User's detriment are announced by email and a notice on the site at least [30] days before they take effect. A User who does not accept the change may close their account before the effective date.

12. Termination and account deletion

The User may delete their account at any time from the account settings. When a Parent account is deleted, the student profiles and reports linked to it are also deleted. Records that must be kept by law (e.g. invoice details) are retained for the statutory periods.

If the User materially breaches this Agreement, the Company may suspend or close the account after notifying the User. In urgent cases that threaten students' safety, notice may be given afterwards.

13. Governing law and disputes

This Agreement is governed by the laws of the Republic of Türkiye. Users who are consumers may apply to the Consumer Arbitration Committee at their place of residence or where the transaction took place, within the monetary limits announced each year by the Ministry of Trade, and to the Consumer Courts for disputes above these limits. For disputes with institutional Users, the Courts and Enforcement Offices of [CITY] have jurisdiction.
